Welcome to JK Bears Digital! These Terms of Use ("Terms") govern your access to and use of the games, websites and services of JK Bears Digital (collectively the "Services"), including "Bears Tic Tac Toe". By accessing or using the Services, you agree to these Terms.
1. Acceptance of Terms
By using our Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you may not use our Services. If you are a minor in your jurisdiction, your parent or legal guardian must read and accept these Terms on your behalf.
2. Use of Services and User Conduct
Our games, including "Bears Tic Tac Toe", are provided solely for your personal, non-commercial entertainment. You agree not to use the Services for unlawful purposes or in any way that disrupts, damages or impairs the Services. You also agree NOT to:
- Use cheats, exploits, automation software, bots, hacks or other unauthorized third-party software intended to modify or disrupt the game experience.
- Harass, threaten or behave in a harmful manner toward other players.
- Attempt to gain unauthorized access to our servers or other players' accounts.
3. In-App Purchases and Virtual Items
Final Purchase Decision
All in-app purchases, such as those for "Premium Bear Points" or "rarest coins", are final and non-refundable, unless otherwise required by applicable law or the refund policy of Google Play / Apple App Store.
Payment Processing
All payments for in-app purchases are securely processed through third-party platforms (e.g. Google Play). JK Bears Digital does not directly process your payment details. These transactions are subject to the terms and conditions of the relevant platform.
Virtual Items
Virtual items such as "Premium Bear Points" and "rarest coins" are licensed to you for use within the game. They have no real-world monetary value and cannot be exchanged for real money, goods or other services from JK Bears Digital or any third party. Your license to use virtual items terminates if your account is terminated.
4. Account Termination
We reserve the right to suspend or terminate your access to the Services at any time, without prior notice or liability, for any reason, including if we reasonably believe that you have violated these Terms. Upon termination, your right to use the Services and all associated Virtual Items ceases immediately.
5. Intellectual Property
All intellectual property rights relating to the Services and content made available through the Services (including games, titles, characters, images, code and virtual items) belong to JK Bears Digital or its licensors. You are granted a limited, non-exclusive, non-transferable and revocable license to use the Services for your personal entertainment.
6. Limitation of Liability
To the maximum extent permitted by applicable law, JK Bears Digital shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, arising out of:
- Your access to, use of or inability to access or use the Services.
- Any conduct or third-party content on the Services.
- Any damage or loss caused by use of the app, or by temporary unavailability of the service.
- Unauthorized access to, use of or alteration of your transmissions or content.
We provide the Services "as is" and "as available", without any warranty of any kind.
7. Changes to the Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website or in our games. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to principles of international private law.
